Terms and Conditions
As
a Checkmystats Merchant you agree to these
network rules and guidelines:
These are the rules and conditions of doing
business with the Checkmystats Merchant program.
These rules are in place to protect Merchants and Affiliates within our network.
Should there be any violation of these terms and conditions of business we reserve
the right to suspend or cancel any account with no payment being made to the account
in question. This is not negotiable. Should a payment be made and we find that this
payment was made to an agent through an illegal or fraudulent action by the agent,
we reserve the right to stop payment on the check and we may also take civil or
criminal action against the company or individual. We are very keen to take every
precaution to ensure to the best of our ability that advertisers, agents, and
ourselves are protected.
Participation in our program:
While we do accept sites that have adult content
into our network as well as incentive based
sites you MUST select the check box that
indicates adult content or incentive content
during the Affiliate sign up process.
We DO NOT accept any sites that are of any
Illegal nature or any Libelous or defamatory
sites, hacking sites, software copying/piracy,
hate, or racial hate sites.
Fraud Control:
We have built into our software a fraud
control system, which monitors all agents' sites
constantly, including false registration. The Checkmystats staff will verify all
sites for legitimacy. Any company or Individual
that tries to artificially inflate traffic
counts, revenue, or use any devise, or
robot/program to inflate sales will be reported
to the appropriate authorities for fraud.
Payments:
Payments are sent out on or before the 20th of each month. The affiliate's first
payment will be made on the 20th of the proceeding month. For example all commissions
due from the 1st to 31st of May will be paid out on the 20th July. Once they have received
their first check, they will then receive further checks on or about the 20th of each month
subject to our minimum requirements. The minimum check value in any month is $50.00. Commissions
less than this amount will be rolled over to the following month's sales. Checkmystats reserves
the right to withhold commission payments from affiliates accounts if funds are not received from
the Merchant. All statistical data reported in real-time should be used as a guide that reflect
potential end of month earnings.
Advertising:
Checkmystats will provide all
marketing material to you on behalf of the
Merchant. Under no circumstances should
Affiliates modify the marketing material
provided to you unless otherwise noted or
permission given,
No Guarantees:
Checkmystats makes no warranties, guarantees, or representations regarding the
revenue or profit an agent can make from the Checkmystats program.
The Checkmystats program makes no guarantees or representations regarding any
information contained in any promotional material and/or oral communications
made by any Checkmystats representative, its employees, or agents. The agent
assures that it has not relied upon any oral and/or written information
provided by the Checkmystatsprogram. Like any business the success of the
program is very much in the hands of the agent to promote and expose their website
to generate sufficient traffic to their site, or advertisements to generate sales,
clicks and whatever is required to generate income for the agent.
Independent Contractor:
The agent is an independent contractor. Checkmystats owners shall not provide any legal,
accounting, or professional advice. The agent is responsible for the agent's (company or individual)
tax obligations. The agent is not an employee, partner, shareholder, or Director of the Checkmystats
program, and shall not enter into any agreement oh behalf of the Checkmystats program.
Applicable Law: Arbitration
The above terms and conditions of business
constitutes the entire understanding of both
parties hereto with respect to its subject
matter and supersedes any and all previous
contracts and covenants between both parties
whether written or oral, with respect to such
subject matter.
Payment
Checkmystats
aggregates each publisher's total commissions
earned each month from all advertisers they
partner with and all links used, and if this
amount exceeds AU$50, Checkmystats sends
them a paycheck, Direct Deposit or via
PayPal. For this reason, each advertiser is
required to keep a balance of $200 AUD in their
Checkmystats account so their Affiliates can be
paid by Checkmystats..
Service Fee
Checkmystats service fee is dependent upon the commission structure stipulated by the
merchant and what is paid to the Affiliate. For example, if a Merchant is willing to pay an
Affiliate $1 per sale, the Affiliate will receive $1, Checkmystats will receive $.25c.
The total cost to the Merchant is $1.25.
